Charges were filed Thursday in the killing of 3-year old Kamille "Cupcake" McKinney. Patrick Stallworth, 39, and Derick Brown, 29, were charged with capital murder. Both are being held without bond. The charges were announced by Jefferson County District Attorney Danny Carr, who did not say if he intends to seek the death penalty. Birmingham police chief Patrick Smith said the investigation is ongoing.
